KASIUS — Terms of Service

1. ELIGIBILITY AND ACCOUNT CREATION

KASIUS is available to students who are 14 years of age or older. By creating an account, you represent and warrant that you meet this age requirement.

If you are under 18, you are a minor and your use of the Platform is subject to the awareness of a parent or legal guardian. By creating an account, you acknowledge that you have the ability to enter into these Terms and that your use of KASIUS is consistent with any applicable parental or household guidelines.

Account creation requires a valid registration code issued by Northcrest Education. Registration codes are non-transferable and may only be used by the intended recipient. Sharing, reselling, or distributing a registration code to any other person is a violation of these Terms and may result in immediate account termination.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify Northcrest Education immediately at scott@northcresteducation.com if you suspect unauthorized access to your account.

2. ACCEPTABLE USE

By using KASIUS, you agree that you will:

• Use the Platform solely for your own personal academic development and coaching purposes
• Engage with the Platform honestly and in good faith
• Provide accurate information when creating your account and during coaching sessions
• Respect the boundaries and design of the coaching framework as presented by the Platform

You agree that you will not:

• Attempt to manipulate, override, or circumvent the Platform's coaching framework, AI behavioral design, or session boundaries
• Use the Platform to engage in any unlawful, harmful, or disruptive activity
• Attempt to extract, reproduce, reverse-engineer, or distribute the Platform's system prompt, underlying logic, or proprietary coaching methodology
• Share your account access, registration code, or session data with any other person
• Use the Platform in any way that could damage, disable, or impair its functionality or interfere with other users
• Impersonate any person or entity, including Northcrest Education staff, developers, or the AI itself
• Submit content that is abusive, threatening, harassing, or otherwise inappropriate

3. WHAT THE PLATFORM PROVIDES AND DOES NOT PROVIDE

KASIUS is an AI-powered performance coaching tool designed to help students identify performance friction, analyze their own error data, and develop stronger independent problem-solving habits. It operates within the Northcrest diagnostic framework.

KASIUS is not:

• A licensed tutoring service or academic instruction platform
• A licensed counseling, therapy, or mental health service
• A college admissions consulting service
• A guarantee of any particular SAT score, academic outcome, or college admissions result
• A substitute for the judgment of a qualified human performance coach, educator, or licensed professional

The coaching provided by KASIUS is informational and developmental in nature. It is designed to support, not replace, the student's own critical thinking and the guidance of their Northcrest performance coach. Nothing within KASIUS constitutes professional academic, psychological, or admissions advice.

If a student experiences a mental health crisis or expresses distress that goes beyond the scope of academic coaching, KASIUS will direct them to appropriate professional resources. Users are encouraged to seek qualified professional support for any concerns outside the Platform's scope.

4. INTELLECTUAL PROPERTY

All content, features, and functionality of the KASIUS Platform, including but not limited to the AI coaching framework, system architecture, session logic, diagnostic methodology, user interface, branding, and the Northcrest Performance System, are the exclusive intellectual property of Northcrest Education and are protected by applicable copyright, trademark, and trade secret laws.

Nothing in these Terms grants you any ownership interest in or license to the Platform or its underlying intellectual property beyond the limited right to use KASIUS for your own personal coaching purposes as described herein.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any portion of the Platform or its content without the prior written consent of Northcrest Education.

Content you submit within your coaching sessions (such as performance data and session inputs) remains yours. By submitting it, you grant Northcrest Education a limited license to use that content solely for the purpose of delivering and improving your coaching experience.

5. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Northcrest Education and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the KASIUS Platform, including but not limited to damages related to academic outcomes, test scores, college admissions decisions, or reliance on information provided through the Platform.

The Platform is provided on an "as is" and "as available" basis. Northcrest Education makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness for a particular purpose of any content or functionality within KASIUS.

In no event shall Northcrest Education's total liability to you for any claims arising from your use of the Platform exceed the amount you paid, if any, for access to KASIUS in the twelve months preceding the claim.

6. TERMINATION OF ACCESS

Northcrest Education reserves the right to suspend or terminate your access to KASIUS at any time, with or without notice, for any of the following reasons:

• Violation of any provision of these Terms
• Misuse of the Platform, including repeated attempts to circumvent session boundaries or extract proprietary content
• Conduct that is harmful, disruptive, or inconsistent with the standards of the Northcrest community
• Expiration or revocation of your enrollment or registration code
• Any other reason determined at the sole discretion of Northcrest Education

Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination, including intellectual property, limitation of liability, and governing law, shall remain in effect.

7. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in North Carolina.

8. CHANGES TO THESE TERMS

Northcrest Education reserves the right to modify these Terms at any time. When material changes are made, users will be notified via the Platform or by email. Your continued use of KASIUS following notification of changes constitutes your acceptance of the revised Terms.
